The Fair Labor Standards Act requires one and a half times the regular rate for every hour over 40 in a workweek, and sets no daily limit. Several states pay overtime by the day as well.

There is no daily threshold. Hours over 40 in the week are weekly overtime.

How the after-tax figure was found

The United States take-home engine runs on a year at 40 hours a week, $74,880.00, and again with 52 weeks like this one, $88,920.00. The $14,040.00 more gross brings $9,877.14 more take-home pay.

From 2025 the premium part of FLSA overtime, the half in time and a half, can also be deducted on Schedule 1-A at year end, up to $12,500, or $25,000 on a joint return. Withholding does not see it, so it shows up in your refund; the tax refund calculator includes it.

How this is calculated

Overtime law answers three questions: when an hour becomes overtime, counted by the day, the week or the month; what it pays, a flat premium or one that steps up; and whether the law sets a premium at all. The calculator takes your hours for each day of a week and your hourly rate, applies the statutory rule of your country, or of your state or province where it pays more, and prices every hour at its multiplier. It then runs the country's take-home engine with and without the overtime to show what an overtime week adds after tax.

week's payrate × regular hours + Σ (rate × multiplier × overtime hours)

regular hours
hours up to the daily and weekly thresholds

1.5 for time and a half, 2 for double time, 1 where the law sets no premium
Thresholds and multipliers come from the working-time dataset listed under Data sources. The guide works a 45-hour American week, a California week with a 13-hour day and a French week.

What this does not include

  • Night, weekend and public holiday premiums, which follow their own rules.
  • Exempt employees: salaried managers and professionals outside the overtime rules.
  • Overtime averaged across several weeks under a written averaging agreement.
  • Time off in lieu instead of overtime pay.
  • Bonuses and commission folded into the regular rate for overtime purposes.

How overtime is paid: thresholds, premiums and the tax on top. Daily and weekly thresholds, tiered premiums, why some countries pay no premium at all, and how much of an overtime hour you keep after tax.
